WHO WE ARE AND WHAT THESE TERMS COVER
The Department of Aliveness is operated by Alexander Geoffrey LLC (“the Department,” “we,” “us,” or “our”). These Terms cover our website, writing, downloadable resources, one-to-one sessions, the Living Room, cohorts, retreats, paid memberships, and other experiences we offer, together called the “Services.”
The Department of Aliveness is an independent business. Our name, departmental language, and visual identity are creative expressions. We are not a government agency or affiliated with one.
Please review these Terms before registering or buying. When we ask you to accept these Terms during registration or checkout, your affirmative acceptance forms an agreement with Alexander Geoffrey LLC. The description and terms presented for your particular purchase also form part of that agreement. We provide a confirmation you can retain.
A separate participant agreement may address a specific experience, including eligibility, activities, payment schedules, cancellations, and withdrawals. If documents conflict, mandatory law controls first, followed by the separate participant agreement, the specific terms disclosed at checkout, and then these Terms. A later policy change does not retroactively change an existing purchase. Our Privacy Policy separately explains how we handle personal information.
2
WHO MAY PARTICIPATE
Our Services are intended for adults aged 18 or older. By registering or purchasing, you confirm that you meet this requirement and can enter into a binding agreement under the law that applies to you. You must provide accurate registration and payment information and keep your account credentials secure.
Availability may vary by location. We may decline a booking before accepting it if an experience is unavailable or unsuitable for delivery in your location. If we have already charged you for an unaccepted booking, we will refund that charge.
3
THE NATURE AND LIMITS OF OUR SERVICES
The Department offers a wellbeing community, educational resources, reflection, and facilitated experiences. Our work may include conversation, writing, meditation, yoga, breath practices, movement, or other activities described for the particular experience.
These Services do not provide medical care, psychotherapy, mental health treatment, diagnosis, rehabilitation, or crisis intervention. Participation does not establish a physician-patient, therapist-patient, or other clinical relationship with Alexander Geoffrey LLC, Alex Lovell, or a facilitator. Academic titles and wellbeing credentials do not change the scope of the Services.
Our materials and conversations are not substitutes for individualized advice from appropriately licensed physical or mental health providers. Consult those providers about symptoms, diagnoses, treatment, medication, and whether a practice is appropriate for you. Do not delay seeking care or change prescribed treatment because of something shared through the Department.
The Department is not appropriate as the primary source of support during an active physical or mental health crisis. Our email, community spaces, messages, and sessions are not monitored as emergency services. If you need urgent help or are at immediate risk, contact local emergency services or an appropriate crisis service in your country.
We do not promise a particular emotional, physical, social, or other outcome. Individual experiences and testimonials reflect the people who share them and do not guarantee your results.
4
YOUR CHOICES DURING AN EXPERIENCE
Participation in any exercise or personal sharing is voluntary. You may decline a question, adapt an activity, pause, or stop. Tell the facilitator about access needs or limitations relevant to your participation without sharing more personal information than necessary.
Reflection and physical practices can bring up strong emotions or physical discomfort. Follow the instructions provided, remain within your abilities, and stop if you feel unwell or unsafe. Seek professional advice when appropriate. Use guided relaxation and meditation only in a setting where reduced attention is safe, never while driving or operating machinery.
These provisions explain the scope of participation. They do not release us from responsibilities that the law places on us or replace any separate informed-consent process required for a particular activity.
5
RESPECT AND COMMUNITY PRIVACY
Treat other participants with care and respect. Harassment, threats, discrimination, exploitation, impersonation, unwanted solicitation, and interference with other people’s participation are prohibited. You must not misuse our systems, bypass access restrictions, distribute malicious code, or collect other participants’ information without permission.
You control what you share. Do not publish, repeat, photograph, record, transcribe, or distribute another participant’s personal story, identity, messages, image, or voice without their express permission. This includes screenshots and personal AI meeting assistants. A facilitator’s permission alone does not authorize recording other participants.
We require participants to respect these boundaries, but we cannot guarantee that everyone will comply or that an online platform is completely secure. Community conversations do not carry the same legal protections as confidential communications with a licensed healthcare provider. We handle information as explained in our Privacy Policy, including disclosures required by law or otherwise lawfully necessary to address serious safety concerns.
6
RECORDINGS AND ONE-TO-ONE NOTES
Cohort sessions are not recorded. Participants may not record or enable AI transcription of cohort sessions.
For one-to-one sessions, we may keep written notes and, with separate advance consent, use recording, transcription, or AI-assisted summaries. Before those tools are enabled, we explain what will be captured, the provider involved, the purpose, who can access the information, and how long it will be retained. You may decline recording or AI transcription and request a session without those features. You may also ask us to stop them during a session. Written notes and information already collected remain subject to the Privacy Policy and applicable rights.
Any proposed recording of another type of experience requires a separate notice and the permissions required for everyone involved. Accepting these Terms does not authorize publication of your image, voice, personal story, or testimonial. We seek separate permission for promotional use.
7
PRICES AND PAYMENTS
The applicable offer and checkout state the price, currency, included services, and any taxes or additional charges before you buy. You authorize the payment you select. Payment processing is handled through Stripe, which has its own terms and privacy notice.
A payment plan divides the price of a particular purchase into installments. It is different from an automatically renewing membership. The terms disclosed before purchase explain the amount and timing of installments and what, if anything, remains due following withdrawal. Mandatory cancellation and refund rights always apply.
8
RESCHEDULING AND CANCELLATIONS
For one-to-one appointments, rescheduling is permitted with advance notice and is subject to availability. Use the booking link or email departmentcontact@dralexlovell.com. The booking page states the notice deadline and the time zone used to determine it. Unless a different deadline is clearly disclosed and accepted before purchase, notice must reach us before the calendar date of the appointment in the appointment’s stated time zone.
Same-day cancellations and missed sessions or scheduled experiences are not refundable, except where applicable law or the specific purchase terms require otherwise. A request made on the scheduled date is treated as a same-day cancellation unless we agree to an exception. We may offer discretionary flexibility, but one exception does not change the policy for future bookings.
The Living Room and other group experiences have scheduled dates that may not be individually rescheduled. Their cancellation, transfer, and refund terms are disclosed on the registration page. Cohort and retreat withdrawals are governed by the participant agreement provided before purchase. We do not introduce undisclosed withdrawal charges after you buy.
If a discretionary cancellation charge would be unlawful or disproportionate under applicable consumer law, we apply only the charge the law permits, taking account of any required assessment of our actual loss, avoided costs, and ability to refill the place.
9
REFUNDS AND PROCESSING FEES
Refunds are provided when required by law or by the specific terms of your purchase. For an otherwise eligible voluntary cancellation refund, we may deduct only the actual credit-card processing fee paid on that transaction that the processor does not return to us, and only if that deduction was clearly disclosed before purchase and is lawful. We do not add a separate administrative fee under this clause.
We do not deduct processing fees where a full refund is legally required, where the law prohibits the deduction, or where we cancel or fail to provide the purchased Service. We explain any permitted deduction when processing the refund. Refunds normally return to the original payment method, subject to applicable law and the provider’s processing time. Any legally required refund deadline takes priority.
If we cancel an experience or make a material change that prevents us from delivering what you purchased, you may choose an available replacement or receive a refund for the affected, undelivered part, including the entire purchase when required by law. We do not require you to accept a credit instead of a refund you are entitled to receive.
10
MEMBERSHIPS AND AUTOMATIC RENEWAL
A membership renews automatically only if you expressly choose and authorize a recurring plan. Before payment, we disclose the recurring amount, billing frequency, renewal timing, any minimum commitment, and how to cancel. For a trial or promotional period, we also disclose when it ends and the amount charged afterward. We send confirmations and reminders required by applicable law.
You may stop future renewals using the online cancellation method identified at checkout or by emailing departmentcontact@dralexlovell.com. We process cancellation requests promptly. A request received before the next renewal is charged will stop that charge; if we fail to do so, we will refund it. We will not require a telephone call for a membership purchased online.
Unless you request immediate closure or a refund changes your entitlement, access continues until the end of the paid period. Refunds for the current period follow the terms disclosed before purchase and your legal rights. Any price or material renewal-term change is communicated in advance, with an opportunity to cancel and fresh agreement where required.
11
MANDATORY CONSUMER RIGHTS
Nothing in these Terms excludes or reduces rights that cannot lawfully be waived, including rights relating to service quality, defective digital content, unfair terms, misleading descriptions, cancellation, refunds, or remedies available in your country, state, or province.
Where European Economic Area or UK distance-selling rules apply, eligible service and digital-content contracts generally have a 14-day withdrawal period starting when the contract is concluded. You may exercise an applicable right by sending a clear cancellation statement to departmentcontact@dralexlovell.com. Where required, we also provide the statutory cancellation information, model withdrawal form, and online withdrawal function before purchase.
If you expressly request a service to start during that period, you may owe a proportionate amount for work actually provided before cancellation only when the legal conditions have been met. A service cancellation right ends on full performance only when the required prior consent and acknowledgment have been obtained. For immediately supplied digital content, loss of the withdrawal right requires the separate express consent, acknowledgment, and confirmation required by law. Merely accepting these Terms is not that consent.
Some activities scheduled for a specific date may qualify for a statutory exception, but we do not assume that every cohort, session, or retreat is exempt. Any applicable exception is explained before purchase. Provincial Canadian and US state cancellation or other consumer protections also continue to apply where relevant.
12
OUR CONTENT AND YOUR CONTRIBUTIONS
Our writing, recordings, downloads, designs, practices, and other materials belong to us or our licensors. Unless an offer expressly grants broader permission, your purchase or access gives you a personal, nonexclusive, nontransferable license to use the materials for your own purposes. Do not resell them, distribute paid materials, or use them to deliver a competing commercial offering without permission. These restrictions do not limit uses allowed by copyright law.
You retain ownership of content you contribute. You grant us only the permissions reasonably necessary to host, display to the audience you choose, deliver, and moderate that content as part of the Services. This permission does not authorize us to turn private contributions into advertising, publish your personal story elsewhere, or train a general-purpose AI model on it. Separate consent and applicable privacy requirements govern those uses. Deletion and retention are addressed in our Privacy Policy.
13
THIRD-PARTY SERVICES
Some functions are delivered through third-party platforms. You may need to accept their terms to use their services. Their own independent data practices are governed by their privacy notices. We remain responsible for our own obligations and for the providers acting on our behalf as required by law. External links do not necessarily indicate an endorsement.
14
ACCESS CHANGES AND ENDING PARTICIPATION
We may restrict access when reasonably necessary to address a serious breach of these Terms, protect participants, comply with law, or respond to a security problem. Where practicable and appropriate, we explain the concern and give you an opportunity to address it. We may act immediately where delay could cause harm.
Refunds following termination are determined by the circumstances, the terms disclosed before purchase, and applicable law. If we end paid Services for reasons unrelated to your breach, we refund the unused portion or provide the greater remedy required by law. Ending access does not remove your privacy rights or any rights that already arose.
15
RESPONSIBILITY AND DISPUTES
We use reasonable care in providing the Services. The website may occasionally be unavailable, and informational material may contain errors. To the extent permitted by law, we do not promise uninterrupted access or that general educational material will meet every person’s needs.
To the extent permitted by law, neither party is responsible to the other for indirect or consequential business losses arising from the Services. This does not exclude liability for fraud, deliberate misconduct, gross negligence, death or personal injury caused by negligence where exclusion is prohibited, violations of mandatory privacy or consumer rights, or any other liability that cannot lawfully be excluded. It does not remove remedies the law gives consumers for reasonably foreseeable loss.
If a concern arises, contact departmentcontact@dralexlovell.com so we can try to resolve it. This is an invitation, not a condition that delays your right to contact a regulator, seek urgent relief, or start a claim. These Terms do not impose mandatory arbitration or a class-action waiver.
Subject to mandatory consumer protections, these Terms are governed by the laws of Utah, United States. Nothing requires a consumer to give up the protections of their home jurisdiction or bring a claim in a court that the law does not permit us to require.
16
UPDATES AND CONTACT
We may update these Terms prospectively. We post the effective date and latest revision date and give notice of material changes where required. Changes requiring your agreement will be presented for acceptance. If a provision cannot lawfully be enforced, the remaining provisions continue to apply to the extent permitted by law.
